2. Processing and storing personal data and means and purpose of use

a) When visiting the web site

When you visit our web site (www.)fassbender-lawyers.com the browser on your device will automatically send information to the server that hosts our web site. This information will temporarily be stored in a so- called log file. This comprises the following information without your active participation which will be stored until it is automatically deleted:

  • IP-Address
  • Date and time of the request
  • Name and URL of the requested file
  • Web site from which request is made (referrer –URL)
  • browser and operating system of your device and name of the access provider
  • amount of data transferred in bytee

The aforementioned data will be processed by us for the following purposes:

  • to ensure an uninterrupted connection to the web site
  • to ensure the comfortable use of our web site
  • evaluation of security and stability of our web site
  • for additional administrative purposes.

The IP address will be anonymized after 24 hours by zeroing the last octet. Complete deletion will occur within 7 days.

The legal basis for the data processing is Art. 6 para. 1 clause 1 lit. f of the GDPR. Our legitimate interest is based on the above listed purposes for the data processing. We will not use the processed data to draw any conclusions about you personally.

b) Making contact

When you make contact (e.g. via contact form, e-mail, telephone or via social media) data of the user will be processed in the course of dealing with the contact request pursuant to Art. 6 para. 1 clause 1 lit b GDPR. Data of users can be stored in a customer –relationship-management system (CMR System), or a comparable system.

We will delete requests, once they are no longer required. We will review the requests every other year. The statutory duties regarding archiving apply.

3. Forwarding Data

We will not forward your personal data to third parties except for the following purposes.

We will only forward your personal data to third parties, if:

  • you expressly consent pursuant to Art. 6 para. 1 clause 1 lit. a GDPR
  • transmitting the data is necessary to allege, execute or defend legal claims pursuant to Art. 6 para. 1 clause 1 lit. f GDPR and there is no indication that you have a predominant protected interest in a non-transmission of your data.
  • Transmission is required by law pursuant to Art. 6 para. 1 clause 1 lit. c GDPR
  • It is permitted by law and necessary to execute the contractual agreement with you pursuant to Art. 6 para. 1 clause. 1 lit. b GDPR.

4. Rights of data subjects

You have the right to:

  • Request information about your personal data that has been processed by us, pursuant to Art. 15 GDPR. In particular, you can request information on the purpose of processing, the category of personal data, the categories of recipients, to which your data has been or will be disclosed, how long the data is supposed to be stored, the existence of a right to correction, deletion, restriction on processing or contradiction, the existence of a right to complain, the source of your data, in case they were not collected by us, as well as regarding an automated decision making process including profiling and meaningful information regarding details pertaining to the aforementioned topics.
  • To request the correction without undue delay of your incorrect data or completion of your data stored with us pursuant to Art. 16 GDPR without undue delay.
  • To request the deletion of your personal data stored with us as long as the processing of this data is not necessary to execute the right to free speech, and free information, to comply with a legal obligation, or public interest or in order to file, execute or defend legal claims, all pursuant to Art. 17 GDPR.
  • To request pursuant to Art. 18 GDPR the restriction of the processing of your personal data, to the extent you allege that the data is incorrect, that the processing is unlawful, but you do not consent to a deletion of the data and we do not need the data any more but you need the data in order to file, execute or defend claims or if you have brought a complaint against the data processing pursuant to Art. 21 GDPR.
  •  Pursuant to Art. 20 GDPR to receive the data you have provided us with in a structured, common, and machine readable format or request the transmission of this data to a third party controller.
  • Pursuant to Art. 7 para. 3 GDPR withdraw the previously given consent at any time. This will have the consequence that we cannot continue the data processing.
  • Pursuant to Art. 77 GDPR lodge a complaint with a supervisory authority. Usually, you can lodge a complaint with the supervisory authority at your residence, work place or our firm’s seat..

5. Right to Object

If your personal data is being processed based on legitimate interests pursuant to Art. 6 para 1 clause 1 lit. 1 GDPR you have the right to object to the processing of your personal data under Art. 21 GDPR, to the extent the reason for the objection comes from your specific personal situation or if the objection is aimed against direct marketing.

In the latter case you have a general objection right that we will act on regardless of your specific situation.

6. Data security

If you visit our web site we use the common Secure Socket Layer process (SSL), in connection with the highest encryption level that is supported by your browser. Usually this will be a 256-Bit encryption. If your browser does not support a 256-Bit encryption we use 128-Bit v3 technology. You can see, if a specific page of our web site is being transmitted encrypted, if you look at the key respectively lock symbol in the lower status line of your browser.

Aside from that we use appropriate technical and organizational security measures to protect your data against random or intentional manipulations, partial or total loss, destruction or unauthorized access of third parties. Our security features are being constantly improved pursuant to the technological advancements.

7. Plugins and Tools

Google Maps

This page uses through an API the map provider Google Maps. Provider is Google, Inc. 1600 Ampitheather Parkway, Mountain View, CA 94043, USA.

Using Google Maps requires saving your IP address. This information is usually forwarded to a Google server in the USA where it is saved. The controller of this web site does not have any control over this process.

Using Google maps helps to make our web site visually more attractive and to facilitate finding the locations mentioned on our web site. This constitutes a legitimate interest pursuant to Art 6 para. 1 clause 1 lit. 7 GDPR.

Google Web Fonts

In order to achieve a uniform display of fonts this web site uses so-called Web Fonts that are provided by Google. When you visit a web page, your browser downloads the required Web Fonts in your browser cache, in order to correctly display texts and fonts.

For this to happen, your browser must connect to Google’s servers. Through that, Google receives the information that our web site is visited by your IP-address. We use Google Web Fonts for the purpose of achieving an attractive and uniform display of our web site. This constitutes a legitimate interest under Art. 6 para 1 clause 1 lit. f GDPR.

If your browser does not support Google Web Fonts, a standard font from your computer will be used.
